Eligibility & accounts
The Service is for middle and high school students (typically ages 12–14) preparing for the SHSAT, and for the parents or legal guardians who create and manage accounts on their behalf.
- Only a parent or legal guardian, age 18 or older, may create an account. Students do not register independently.
- Only a parent with a valid, active account can provision access to a student user under the age of 18, as described in our Privacy Policy.
- The parent account-holder is responsible for the account credentials, billing, and all activity that occurs under the account, including activity by the student.
- You agree to provide accurate information at signup and keep it current.
- Accounts may not be shared outside the immediate family or created on behalf of a student without that student's parent or guardian's consent.
Plans & billing
Free access
We offer a free diagnostic and limited practice access. Free features may change over time.
Paid plans
Additional features and practice volume are available through paid plans, as described on our pricing page.
- Automatic renewal: paid plans renew automatically each billing period at the then-current price until canceled.
- Cancellation: you may cancel anytime from account settings or by emailing support@mysmartmentor.com. Cancellations within 7 days of the initial charge receive a full refund and revert to the free plan immediately.
- Refunds: first-time subscribers who cancel within the 7-day window receive an automatic full refund. Other charges are non-refundable except where required by law.
- Price changes: we may change prices with at least 30 days' notice to your account email. Continued use after the change constitutes acceptance.
Usage limits & fair use
To keep the Service reliable and sustainable, AI-powered features (e.g. adaptive diagnostics and personalized study plans) are subject to usage limits that vary by plan. Some actions may also be subject to technical rate limits to prevent abuse.
- Current usage limits per plan are described on our pricing page.
- When a usage limit is reached, the affected AI-powered feature becomes temporarily unavailable until it resets or your plan is upgraded.
- Attempting to circumvent limits — including through bots, scripts, shared credentials, or multiple accounts — violates these Terms and may result in suspension.
- We may adjust usage limits for a plan with at least 30 days' advance notice by email.
- The core diagnostic and any non-AI features are not subject to these usage limits, unless otherwise stated in the product.

DMCA / copyright takedown
If you believe content available through the Service infringes your copyright, send a written notice to support@mysmartmentor.com with the subject line "DMCA Takedown Request," including: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material on the Service; (c) your contact information; (d) a good-faith statement that the use is unauthorized; (e) a statement, under penalty of perjury, that the notice is accurate and you're authorized to act; and (f) your signature.
We will respond to valid notices and, where appropriate, remove or disable access to the infringing content. Repeat infringers may have their accounts terminated.
AI-generated content
My Smart Mentor uses AI to generate practice questions, hint responses, and personalized study plans, and to classify errors in student work. We work to ensure quality, but AI-generated content may occasionally contain errors, and we do not warrant that it is accurate or complete.
AI-generated content supplements — and does not replace — thorough SHSAT preparation. Outcomes vary by student.
Privacy
Your use of the Service is also governed by our Privacy Policy, including COPPA protections for users under 13. We use limited, aggregated, de-identified analytics to understand how the Service is used. We do not use advertising measurement tools, and student practice data, shown work, and tutor conversations are never shared with advertising platforms or used to build advertising profiles.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that using My Smart Mentor will improve SHSAT scores or result in admission to any specialized high school. Outcomes depend on many factors outside our control.
Limitation of liability
To the fullest extent permitted by law, My Smart Mentor and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of the Service.
Our total liability for claims related to these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim.
Termination
We may suspend or terminate an account for violating these Terms, fraud, or misuse of the Service. You may close your account at any time by contacting support@mysmartmentor.com.
Governing law, arbitration & disputes
These Terms are governed by the laws of New York State, without regard to conflict-of-law principles.
Please read this section carefully — it affects your legal rights.
You and My Smart Mentor agree to resolve any dispute arising out of or relating to these Terms or the Service through binding individual arbitration, rather than in court, except that either party may bring qualifying claims in small claims court. Both parties waive the right to a jury trial and to participate in a class action, class arbitration, or representative proceeding.
Arbitration will be conducted by the American Arbitration Association ("AAA") under its consumer arbitration rules (adr.org). The arbitration will be conducted in New York County, New York, or, at your election, by telephone or videoconference. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
Nothing in this section prevents either party from seeking emergency injunctive relief in court to prevent irreparable harm while arbitration is pending.
If you do not wish to be bound by this arbitration agreement, notify us in writing within 30 days of first accepting these Terms at support@mysmartmentor.com with the subject line "Arbitration Opt-Out." Opting out does not affect your right to use the Service.
Changes to these terms
We may update these Terms and will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after that date constitutes acceptance of the revised Terms.
